MASSIVE Blow for BIG Pharma

1st October 2020, High Court Rules in favour of ANHPSA (The Alliance of Natural Health Products South Africa).

In our Summer Edition 2019/20 we published a call to action ‘Your Body Your Right’ in response to the consumers’ right to choose herbal products over pharmaceutical products based on General Regulations to the Medicines and Related Substances Act, 101 of 1965 (Regulations, 2017) that were published on 25 August 2017.

In 2018 the ANHPSA challenged whether the Minister of Health (MoH) under S35 of the Medicines Act is empowered to regulate all complementary medicines as contained in the regulations. Odyssey Magazine has always viewed this as ‘ultra vires’ (action taken beyond legal power or authority). On 1 October 2020 the high Court ruled in favour of ANHPSA. This ruling has major implications for our industry, however, the court’s ruling may either be considered a fair judgement or appealed by SAHPRA (South African Health Products Regulatory Authority).

We will be covering this much needed ‘shot in the arm’ for the CAMs/CM and Health Products sectors and the reinforcement of our rights to the protection of individual freedoms in our summer edition 2020/21.

With co-operation from all invested participants we hope to bring you a full report on the redrafting process which will now have to ensue and an in-depth review of our industry’s Odyssey, the journey, to this major and most welcome turn around and the way forward.
